These Terms of Service ("Terms") are an agreement between you and QueenPilot, Inc., a Delaware corporation ("QueenPilot", "we", "us"). They govern your use of the QueenPilot website, web and mobile apps, booking pages, AI features and related services (together, the "Service").
By creating an account, booking through a QueenPilot booking page, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you may bind that business, and "you" includes the business.
1. Who the Service is for
Businesses. Salons, studios, independent professionals and other beauty and wellness businesses ("Business Customers") use QueenPilot to run their business: online booking, calendar, clients, team, checkout and cash desk, stock, reports, messaging and AI features.
Clients. People who find, book and manage appointments with a Business Customer through the Service ("Clients"). A Client's appointment is an agreement between the Client and the business. QueenPilot is not a party to it, does not provide the beauty or wellness services, and is not responsible for their quality, price, timing or safety.
You must be at least 18 years old (or the age of majority where you live) to open a business account, and at least 16 to use the Service as a Client.
2. Your account
- Give accurate information and keep it up to date.
- Keep your login details secret. You are responsible for everything done under your account and the accounts of team members you invite.
- Tell us at once at [email protected] if you suspect unauthorized use.
- Business Customers decide which team members get access and what each one can see and do.
3. Free trial, plans and payment
Free trial. New business accounts get 2 months free with every feature, unless an offer states otherwise. We may change or end trial offers for new accounts at any time.
Plans. Our current plans and prices are shown on our pricing page. Plan prices depend on the number of team members, meaning each person assigned to a location, the owner included. Paid add-ons (such as AI marketing plans, extra content packs and AI wallet credit) are priced separately.
Billing. Subscriptions are billed in advance, monthly or yearly, in US dollars, through our payment processor Stripe. By giving a payment method you authorize us to charge it for the subscription, add-ons and applicable taxes. Subscriptions renew automatically for the same period until you cancel.
Team changes. When you add team members during a paid period, we may charge the prorated difference for the rest of that period, or add it to your next renewal. Removing team members lowers the price from your next renewal.
Taxes. Prices do not include sales tax, VAT or similar taxes, which we add where the law requires.
Price changes. We may change prices. We will tell you at least 30 days before a change applies to your subscription; it takes effect at your next renewal after that notice. If you do not agree, you can cancel before then.
Failed payments. If a payment fails, we will let you know and try again. After a grace period of 7 days we may pause the account until payment is made. Your data stays while the account is paused.
Cancellation and refunds are covered by our Refund and Cancellation Policy, which is part of these Terms.
4. AI features
The Service includes features that use artificial intelligence, including an AI receptionist that replies to Clients for a business, an AI assistant inside the business account, and an AI marketing autopilot that prepares and publishes social media content.
- The business stays in charge. The AI receptionist acts on the business's instructions, services, prices, working hours and rules. Business Customers are responsible for setting it up correctly, reviewing its conversations and stepping in when needed.
- AI can make mistakes. AI output may be inaccurate or incomplete. Check important information, such as prices, times and bookings. QueenPilot does not guarantee any particular result from AI features.
- The assistant prepares, you confirm. The AI assistant can read your business data and prepare bookings, forms and changes for you to confirm; changes are saved only when you confirm them.
- Marketing content. The AI marketing autopilot creates posts, Stories and Reels mainly from photos and information you provide, and may create AI-generated images where you allow it. You are responsible for content published to your accounts, whether you approve each piece or let it publish on schedule.
- Usage-based charges. Some AI features, such as AI receptionist replies, are paid from prepaid AI wallet credit at the rates shown in your account.
5. Messaging channels and other services
The Service connects to third-party services that you choose to link, such as WhatsApp, Instagram, Facebook Messenger, Yelp, Google and payment providers. Your use of those services is governed by their own terms. You are responsible for having the right to connect your accounts and for following those platforms' rules, including rules on messaging customers. We are not responsible for third-party services, their availability or changes to them.
6. Your content and data
You own your content. Business Customers own the data and content they put into the Service, including client records, services, prices, photos and messages ("Customer Content").
License to us. You give QueenPilot a worldwide, non-exclusive, royalty-free license to host, copy, process, display and transmit Customer Content only as needed to provide, secure and improve the Service for you, including showing your business profile and booking page publicly and publishing content to accounts you connect.
Your responsibilities. You confirm that you have all rights and consents needed for the Customer Content you upload or send, including the consent of any person shown in photos and of Clients you message, and that your use complies with privacy, consumer protection, marketing and messaging laws.
Client data. When we process personal data of Clients on behalf of a Business Customer, we act as that business's service provider (processor) under our Privacy Policy, and the business is responsible for its own use of that data.
Reviews. Clients may leave ratings and reviews of businesses after a visit. Reviews must be honest and based on a real experience. We may hide or remove reviews that break these Terms.
7. Acceptable use
You must not:
- break any law or anyone else's rights, or use the Service for services that are illegal where you offer them;
- send spam or messages to people who have not agreed to hear from you;
- upload content that is unlawful, misleading, hateful, sexually explicit, or that infringes intellectual property or privacy;
- post fake bookings or fake reviews, or manipulate ratings;
- try to access accounts or data that are not yours, probe or break our security, or interfere with the Service;
- copy, resell, reverse engineer or build a competing product from the Service, except as the law allows;
- use automated means to scrape the Service or send it excessive requests.
8. Our intellectual property
The Service, including its software, design, text, graphics and the QueenPilot name and logo, belongs to QueenPilot or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. If you send us feedback, we may use it freely.
9. Availability and changes
We work to keep the Service available and secure, but it may sometimes be unavailable for maintenance, updates or reasons beyond our control. We may change, add or remove features. If we remove a material feature you pay for, we will tell you in advance where we reasonably can.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, do not pay, create risk or legal exposure for us or others, or if the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem.
After an account is closed, Business Customers can ask us for an export of their client list and bookings within 30 days. After that we may delete Customer Content as described in our Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, QueenPilot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that it will bring any particular number of bookings, clients or revenue.
12. Limitation of liability
To the fullest extent the law allows: (a) QueenPilot is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) QueenPilot's total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100.
Some places do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
If you are a Business Customer, you will defend and indemnify QueenPilot against third-party claims arising from your Customer Content, the services you provide to Clients, your messages to Clients, or your breach of these Terms or the law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Before starting a formal dispute, please write to us at [email protected] so we can try to resolve it. Any dispute that we cannot resolve will be decided by the state or federal courts located in Delaware, and both parties consent to their jurisdiction. If you are a consumer, you keep any rights the law of your country of residence gives you that cannot be waived.
15. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the Service at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
16. General
These Terms, together with the Privacy Policy and the Refund and Cancellation Policy, are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
